Lynn -- Section 303(d) of the Clean Water Act provides for the development of Total Maximum Daily Loads (TMDLs) as a means of achieving Water Quality Standards (WQS) in water bodies that are impaired. A TMDL sets the allowable loading of a pollutant to achieve compliance with the relevant WQS. While conceptually simple, developing and implementing a TMDL is a difficult and potentially very costly process. While Section 303(d) places the responsibility for the TMDL program on state environmental agencies and US EPA, implementation of the program will significantly affect the regulated community. In particular, the potential exists for significantly more stringent waste water discharge limits, controls on the forest-lands practices, and limits on growth.
