Florida's Total Maximum Daily Load Program, 2000 Environmental Conference Proceedings
- D. Joyner -- Both EPA and FDEP have been actively exploring ways to improve the TMDL program. In Florida, the FDEP has reorganized Department resources, adopted a watershed management approach, and developed comprehensive TMDL legislation. This legislation clarifies the Department's statutory authority and establishes administrative procedures for the program. It also acknowledges the Department's limited regulatory authority for many nonpoint sources of pollution and provides incentives for nonpoint sources that implement applicable Best Management Practices. In contrast, EPA's proposed revisions to the federal TMDL regulations take a more command and control approach and appear to attempt to expand its statutory authority to control nonpoint source pollution.
